A certificate of rehabilitation is a court order stating that a person convicted of a felony has been rehabilitated. Generally, if you have been convicted of a felony and still reside in California, you may apply for a certificate of rehabilitation provided that you meet the requirements of demonstrated rehabilitation pursuant to penal code section 4852.06. Among one of the most important requirements is simply time. In most cases, you will not be eligible to apply for a certificate of rehabilitation until seven (7) years has passed since you were released from custody.

There are other requirements and nuances that without proper representation, you may not know about. For example, special laws apply to those convicted of sex offenses. If you were convicted of certain misdemeanor sex offenses specified in Penal Code section 290, then you may apply if the conviction has first been dismissed under Penal Code section 1203.4. These are things the lawyers here at WILL & WILL, LLP know. If this was the case you were facing, we would first advise you to have us file the proper motion for expungement. Once granted, we would then seek a certificate of rehabilitation on your behalf. It is also imperative to know that those persons convicted of felony offenses under Penal Code sections 286(c), 288, 288a(c), 288.5, or 289(j) are not eligible for a Certificate of Rehabilitation. Lastly, a Certificate of Rehabilitation may relieve some offenders from continuing to have to register as a sex offender under Penal Code section 290.

As you can see, there are many benefits to obtaining a certificate of rehabilitation. For example, it may be used as an application for a Pardon from the Governor’s office (another possibility that WILL & WILL,LLP can help you obtain). However, it is important to note that receipt by the Governor of a Certificate of Rehabilitation does not guarantee that a pardon will be granted. Another benefit is that if you receive a Certificate of Rehabilitation, you cannot be denied a state license due to your conviction. This can aid many people with their jobs in the future. Finally, a certificate of rehabilitation is an excellent sign to any potential employers that you have truly moved beyond whatever difficulties you had in the past.

We will handle all of the legal paperwork involved and be by your side in court to help convince the judge that you truly are rehabilitated.
