Objective signs of alcohol intoxication

After you have been stopped and/or contacted by a police officer or sheriff’s deputy and he/she smells the odor of an alcoholic beverage coming from your breath or person, or from inside the vehicle generally, or for some other reason (like your driving pattern) suspects that you have consumed alcoholic beverages and are driving, he/she will start to look for other indicators to substantiate the belief that you are DUI.

Some of these additional indicators are:

Bloodshot/red eyes
Watery Eyes
Flushed face
Slurred/slow speech
Speaking too softly or loudly
Difficulty with motor skills (retrieving driver's license, registration & insurance)
Difficulty exiting your vehicle
Balance and coordination difficulties (swaying, falling down, or leaning/holding onto car)
Disheveled appearance

Even if you believe none of the factors above can be attributed to you or your behavior at the time of the incident, again, you may be surprised at what appears in a police report. Likewise, even if for example, you tell an officer that you wear contacts and that they have been bothering you, he/she may check off the box on the report forms that indicate that you wear contacts but may still check off the box that says your eyes were red and watery. And, do not be surprised if he/she doesn’t write in the narrative section the fact that you mentioned that your contacts were bothering you.
